Paull REFERENCES: <br />Assista�t County Attorney <br />As'part of the South County Water Distribution System, the <br />Mid -Florida System must be tied into the Vero Mall Distribution <br />System. (See attached letter from Guy Wills to David Greene dated <br />5/7/82.) The County, therefore, must acquire a series of utility <br />easements which extend across three different parcels in order to <br />make the tie-in. <br />In exchange for one of these easements, the owner of the servient <br />parcel, Mr. Floyd Grimm, has requested that the County convey a <br />small parcel of property (.12 acres) located at the corner of the <br />old Mid -Florida site. This property has not been used for the <br />utility operation and in fact was "fenced out" of the site and is <br />overgrown with brush at this time. Mr. Grimm intends to use the <br />.12 acres for parking or drainage retention in conjunction with his <br />abutting property, and will accept the parcel subject to the <br />County's reservation of a blanket easement for future utility pur- <br />poses, not inconsistent with Mr. Grimm's intended use. <br />If the Board elects to make this exchange, Florida Statutes §125.37 <br />requires that published notice of the exchange, containing the <br />terms thereof, be made once a week for at least two weeks prior to <br />the adoption of the resolution authorizing the exchange. <br />Requested Action <br />It is requested by this office that the Board consider Mr. Grimm's <br />request, and if acceptable, give conceptual approval to the terms <br />of exchange and authorize the County Attorney's office to prepare <br />and publish the required resolution, to be adopted at the first <br />available Board meeting following proper publication. <br />Attorney Paull informed the Board that the piece of <br />property desired by Mr. Grimm was appraised in-house <br />at $6,800. This property is overgrown and not in use. <br />Based upon the County's need to acquire the easement and the <br />absence of any use for the property at this time, it is <br />6 <br />
