Hardin, Jr., Ph.D. <br />Acting County Administrator <br />DEPARTMENT HEAD CONCURRENCE: SUBJECT: <br />Patrick Bruce King <br />CARMEN NICOTRA'S APPEAL OF <br />SITE PLAN DENIAL <br />FROM: Art Challacombe REFERENCES: <br />Planning Division Mgr. <br />DESCRIPTION AND CONDITIONS: <br />On May 19, 1982, Carmen Nicotra, President of N&B Realty, <br />submitted a site plan application to construct a 64 unit <br />apartment complex on 3.96 acres of property (proposed <br />density 16.41 units/acre), located at the southwest corner <br />of 6th Avenue and 15th Place. <br />An application for site plan approval was submitted on 24 <br />April 1979 and subsequently approved by the Planning and <br />Zoning Commission at their regular business meeting of <br />December 13, 1979. An extension of the approval was <br />granted improperly by the Planning and Zoning Commission <br />on December 11, 1980. On June 17, 1981, a request for an <br />extension was removed from the County Commission Agenda. <br />i Approval of the site plan has expired. <br />A new site plan application was submitted. The proposed <br />development is identical to that which was previously <br />approved. <br />Based on the fact that the plan does not conform to the + <br />allowable density designated by the Comprehensive Plan <br />(MD -2 up to 10 units/acre), the Planning and Zoning Com.- <br />-mission denied the request for site plan approval. <br />RECOMMENDATION: <br />The County Commission set a date for the appeal to be heard <br />in the form of a public hearing. The suggested date for <br />this public hearing is August 4, 1982. <br />ON MOTION by Commissioner Bird, SECONDED <br />by Commissioner Lyons, the Board unani- <br />mously authorized staff to advertise a <br />public hearing on an appeal of site plan <br />denial by Carmen Nicotra for August 18, <br />1982. <br />43 <br />JUL 14 7982 nog f F.� <br />
