Mr. Cooper now <br />would like to remove the mobile home and construct a new - <br />residence. The lot size is adequate, but there is a road <br />frontage problem and the only solution is a zoning change. <br />The Zoning Board recommended denial based on the finding of <br />the Planning Department that such a rezoning would con- <br />stitute spot zoning since it would give the Coopers, or a <br />successor owner, the right to build a duplex or triplex on <br />the subject lot. Mr. Quinn assured the Board that Mr. Cooper <br />is very serious about building his house, - he has a <br />contract, financing, etc. <br />Attorney Quinn then went into a lengthy argument about <br />what does or does not constitute spot zoning and read <br />definitions which describe spot zoning as that which "allows <br />uses which are inconsistent with the surrounding area" or <br />"permit a radical departure in a small area of a much larger <br />area committed to a very different use." He also felt that <br />spot zoning will result in violation of the neighborhood <br />character and may result in depreciation of neighborhood <br />values. <br />Attorney Quinn then went into a very -thorough <br />description of the area around the Cooper property, noting <br />that all the properties on the north side of 10th Place back <br />up to the commercial properties located along the south side <br />of 12th st. He stressed the large amount of commercial and <br />industrial activity in this area and pointed out that the <br />residences in the surrounding area consist mainly of frame <br />houses in excess of 30 years old and mobile homes which have <br />been added onto. In addition, the lots on each side of the <br />subject property have houses built directly behind one <br />another, and when you drive by this street, you see house <br />behind house on each side of the subject parcel.
