6) Twenty (20) Acre Tracts. Any division of land where <br />all parcels resulting from the division contain twenty (20) acres <br />of land or more and no public easements or streets are created. <br />When the tract prior to dividing is a size which is not an even <br />multiple of twenty (20) acres, a fractional breakdown resulting in <br />lots of equal size which are larger than 19.5 acres also qualifies <br />for the exemption. <br />C. Affidavit of Exemption (Subdivisions resulting in <br />all lots containing more than 5 acres). <br />1. All projects meeting the following requirements <br />shall be exempt from Section 9 (required public improvements) and <br />the platting requirements of this ordinance. <br />(a) Each parcel resulting from the proposed divi- <br />sion of land contains more than five (5) acres. When the tract <br />prior to dividing is a size which is not an even multiple of five <br />(5) acres and does not lend itself to division into lots each con- <br />taining more than five (5) acres, a fractional breakdown resulting <br />in lots of equal size larger than 4-7/8 acres also qualifies for <br />this provision. <br />(b) If the developer elects to divide the land by <br />filing a plat, all requirements of this ordinance except Section 9 <br />(required improvements) shall be complied with. <br />(c) The applicant deeds to the County all rights- <br />of-way necessary to comply with the Indian River County <br />Thoroughfare Plan, and all streets created are at least the mini- <br />mum street width required by Section 10 (C) (2). <br />(d) The owner establishes a landowner's association <br />and simultaneously files a Declaration of Covenants and <br />Restrictions, acceptable in form to the County Attorney, in the <br />Public Records providing that all streets, easements and drainage <br />improvements (except that dedicated to the public) are dedicated <br />to the landowner's association and provisions are made for their <br />perpetual maintenance. The Declaration of Restrictions and plat <br />(if applicable) shall contain the following language in bold type: <br />"The streets, easements and drainage improvements are not <br />dedicated to the public and will not be maintained, repaired or <br />-13- <br />
