improved by the County." <br />(e) The owner files a Declaration of Restrictions <br />prohibiting the voluntary division of land encompassed within the <br />project into lots that are less than 4-7/8 acres in size unless <br />such division is accomplished by filing a plat approved by the <br />County and meets all standards required of subdivisions under this <br />ordinance. <br />(f) The owner files an "Affidavit of Exemption" in <br />the Public Records prior to dividing the land which shall <br />contain: <br />(1) a legal description of the land encompassed <br />within the project and a certified survey depicting all parcels <br />created by the division, all private and public streets and ease- <br />ments, <br />(2) the book and page number of the Official <br />Records of Indian River County where the items required in <br />Paragraphs (c), (d), and (e) may be found, and <br />(3) the approval of the Public works and Community <br />Development Directors and the County Attorney's Office. <br />2. Application process for affidavit. All applicants <br />for affidavits of exemption shall comply with the application pro- <br />cess of Section 7 if the property is to be divided by the filing <br />of a plat provided the applicant shall not have to submit informa- <br />tion relating to required improvements. The applicant and the <br />Community Development Director shall discuss what information is <br />required at the pre -application conference. If the applicant is <br />not filing a plat to divide the property, he shall schedule a <br />pre -application conference and provide information as required by <br />Section 7 (C). Subsequent to the meeting, the Community <br />Development Director shall in writing request such additional <br />information as necessary to evaluate the affidavit of exemption. <br />After receipt of the requested information, the County shall have <br />twenty (20) days to approve and sign the affidavit or notify the <br />applicant in writing citing the provision of this ordinance that <br />constitutes the reasons why the application has not been <br />approved. <br />-14- <br />
