the Indian River County Planning and Zoning Commission for review <br />and consideration for approval. The decision of the Planning and <br />Zoning Commission shall be final unless the application is <br />appealed to the County Commission. Any approval shall be noted on <br />the preliminary plat in the following form: <br />CERTIFICATE OF APPROVAL <br />BY PLANNING AND ZONING COMMISSION <br />THIS IS TO CERTIFY, That on the <br />Indian River County Planning and Zoning Commission approved this <br />preliminary plat. <br />(Chairperson) <br />7) County Commission Consideration (appeals). An <br />appeal may be filed by: <br />(i) the applicant <br />(ii) County administration <br />(iii) any aggrieved person or group with an interest that <br />will be affected by the project. <br />An appeal of a decision on a preliminary plat must be <br />filed with the Community Development Division within ten (10) <br />working days of the meeting wherein the decision appealed was <br />rendered. Upon receipt from the applicant of an appeal, the <br />County Administrator will place the preliminary plat application <br />and all recommendations on the agenda of a regularly scheduled <br />meeting of the Board of County Commissioners for consideration <br />within thirty (30) days. The County Commission will conduct a de <br />novo hearing on the application and receive input from all <br />interested parties. The applicant must receive a majority vote of <br />the members present at the meeting to prevail in the appeal. <br />8) Criteria for Review of Preliminary Plat by County <br />Staff, the Planning and Zoning Commission and the Board of County <br />Commissioners, if Appealed. <br />(a) No preliminary plat shall be approved if it; <br />(1) fails to comply with all ordinances of Indian <br />River County including but not limited to, the <br />Comprehensive Plan, the Zoning Regulations, <br />this ordinance, the Stormwater Management and <br />Flood Protection ordinance and the Indian River <br />-23- <br />
