these access points. <br />3) Construction Beyond Coastal Construction Control <br />Line Prohibited. No improvements, other than dune crossovers, may <br />be constructed eastward of the coastal construction control line. <br />S. Canals and Waterways <br />Width and Depth: The excavation of navigable canals or <br />waterways from submerged lands in Class II waters, aquatic pre- <br />serves or the boundaries of the Pelican Island National Wildlife <br />Refuge is prohibited. When permitted, canals and waterways shall <br />be the minimum width necessary to accomplish the purpose for which <br />they are constructed. An applicant desiring to construct a canal <br />or waterway must affirmatively show a design that will prevent <br />stagnation and eutrophication of the system, provide sufficient <br />flushing and maintain the ambient water quality. The excavation <br />of any such canal or waterway shall not be for the purpose of <br />obtaining fill. <br />T. Bulkheads <br />Bulkheading is not permitted unless the applicant can <br />affirmatively show to the satisfaction of the Board of County <br />Commissioners that the project will not damage the environment or <br />adjoining properties. The applicant shall follow the variance <br />procedure of Section 11. <br />SECTION 11 <br />VARIANCES <br />A. General. Where the Board finds that undue hardship <br />or unreasonable practical difficulty may result from strict com- <br />pliance with this ordinance, the Board may approve a waiver to the <br />requirements of this ordinance if the waiver does not compromise <br />the public interest. <br />B. Conditions. The Board shall not approve a waiver <br />unless it finds all of the following: <br />(1) The particular physical conditions, shape, or <br />topography of the specific property involved <br />would cause an undue hardship to the applicant <br />if the strict letter of the ordinance is <br />carried out; <br />-62- P <br />
