1 2/8/87, 1 (Ord)LEGAL(VIO'TP <br />ORDINANCE NO. 87 - <br />the disposal charges to be imposed upon each parcel of <br />assessable property in the district shall be adopted and <br />transmitted to the Tax Collector for collection. <br />SECTION 9. COLLECTION OF DISPOSAL CHARGES BY TAX <br />------------------------------------------------------- <br />COLLECTOR <br />By authority of 4197.363, F.S., the Tax Collector shall <br />collect and distribute all disposal charges using the same <br />procedure as is used for collecting ad valorem taxes. <br />The owners and description of each parcel of improved <br />real property shall be that designated on the real property <br />assessment tax roll maintained by the Property Appraiser. <br />The discounts for early payment used by the Tax <br />Collector shall apply also to the disposal charge. <br />All annual disposal charges shall be liens against such <br />improved real property as of the first day of January <br />preceding the fiscal year for which the service charge is <br />imposed. <br />Disposal charges not paid before the delinquency date <br />for taxes shall be cause for the Tax Collector to sell a <br />certificate on the property just as if the disposal charge <br />were a tax. All penalties and interest imposed on unpaid <br />taxes will apply. <br />SECTION 10. DISPOSAL CHARGE TO GOVERNMENTAL AGENCIES, <br />------------------------------------------------------- <br />COUNTY AGENCIES, AND PROPERTY OWNER NOT BEING TAXED <br />--------------------------------------------------- <br />The exemption of property from taxation under Florida <br />Statutes, Chapter 196, or any other law or constitutional <br />provision shall not relieve any owner from the provisions of <br />this ordinance or from the imposition by the Board of the <br />disposal charge applicable to such assessable property. All <br />governmental agencies owning property within the district <br />shall pay the appropriate disposal charge. When a tax <br />certificate has not been issued or cannot be sold, the Board <br />shall have the authority and option to enforce the <br />collection of any delinquent disposal charge in court <br />including all penalties, costs, and a reasonable attorney's <br />fee. <br />7 <br />
