9. Obligation of Subgrant Funds. Subgrant funds may not under any circumstances <br />be obligated prior to the effective date or subsequent to the termination date of the <br />subgrant period. Only project costs incurred on or after the effective date of the <br />subgrant application are eligible for reimbursement. <br />10. Audit. BHS, NHTSA, FHWA, and the Auditor General of the State of Florida, or <br />any of their duly authorized representatives, shall have access for purpose of audit <br />and examination of any books, documents, papers, and records of the subgrantee, <br />and to relevant books and records of subgrantees and contractors, as provided by <br />the provisions of section 402(a) of the Highway Safety Act of 1966, Public Law <br />89-564, as amended. <br />11. Equal Employment Opportunity. No person shall, on the grounds of race, creed, <br />color or national origin, be excluded from participation in, be refused the benefits <br />of, or be otherwise subjected to discrimination under,subgrants awarded pursuant <br />to P.L. 89-564, or any project, program, activity, or subgrant supported by such <br />requirements of Title VI of the Civil Rights Act of 1964, and all applicable require- <br />ments pursuant to the regulations of the Department of Commerce (Title 15, Code <br />of Federal Regulations, Part 8, which have been adopted by the Department of <br />Transportation). <br />12. Minority Business Enterprises. <br />(a) Policy. It is,the policy of the Department of Transportation that minority <br />business enterprises as defined in 49 CFR Part 23 shall have the maximum <br />opportunity to participate in the performance of contracts financed in <br />whole or in part -with Federal funds under this agreement. Consequently, <br />the MBE requirements of 49 CFR Part 23 apply to this agreement. <br />(b) MBE Obligation. The recipient or its contractor agrees to ensure that <br />minority business enterprises as defined in 49 CF R Part 23 have the max- <br />imum opportunity to participate in the performance of contracts and sub- <br />contracts financed in whole or in part with Federal funds provided under <br />this agreement. In this regard all recipients or contractors shall take all <br />necessary and reasonable steps in accordance'with 49 CFR Part 23 to en- <br />sure that minority business enterprises have the maximum opportunity to <br />compete for and perform contracts. Recipients and their contractors shall <br />not discriminate on the basis of race, color, national origin, or sex in the <br />award and performance of DOT -assisted contracts. <br />13. Special Conditions: <br />(a) Participate in instructional opportunities provided by the <br />Bureau of Highway Safety; <br />(b) Subgrantee agrees to submit quarterly progress reports <br />for one year after the equipment has been purchased and <br />put to use; <br />(c) All procurements will be in accord with the provisions of <br />Attachment 0 of OMB Circular A-102 and the subgrantee agrees <br />to maintain the equipment in an operable condition. <br />7 <br />785 <br />56 <br />AUG 41992 <br />
