AUG 101982 <br />4 <br />Mr. Challacombe stated that staff does not have any <br />particular recommendation. This is a difficult situation in <br />that while Attorney Kilbride is correct about the mixture of <br />uses; it is principally a residential subdivision even <br />though it.is zoned commercial, and once a house goes down, <br />the resident is unable to replace it. Mr. Challacombe tended <br />to agree with Attorney Kilbride, even though we have been <br />keeping MXD principally on the west side of the highway, <br />that MXD would be appropriate for this area in order for the <br />people to be able to protect existing uses. He continued <br />that what they have done with the other Mixed Use areas is <br />give them definitive boundaries, and he did not feel <br />prepared to do that at this point, but would like to come <br />back with a recommendation. <br />In further discussion, it was noted that hopefully this <br />matter could be resolved tonight so we could move along with <br />the adoption of the plan. Commissioner Lyons noted that it <br />seems the situation is no different whether this stays <br />commercial zoning or MXD, and you take a look at the <br />neighborhood when you rezone in any event. <br />The Board agreed to recess at 7:45 P.M. while Mr. <br />Challacombe and Attorney Kilbride reviewed this matter. <br />The Board of County Commissioners reconvened with the <br />same members present at 8:00 P.M <br />Planning Manager Challacombe reported that he and <br />Attorney Kilbride are in agreement as to a Mixed Use <br />designation and the boundaries they are looking at are from <br />the packing house working southward along and over the <br />subdivision to the end of all existing commercial uses - <br />south to 67th Street. This would include the eastern <br />boundary of Jennings Addition to Quay which would take in <br />some lots on the east side of 33rd.
