He then explained the <br />terms of the Letter of Conditions and that they had recently <br />discovered the County was not in compliance in regard to the <br />rate structure. <br />Commissioner Fletcher inquired if, by waiving those <br />provisions, would it cost the County more money. <br />Mr. Livingood responded that there would be no cost <br />involved to the County. <br />Attorney Brandenburg spoke about the Utility Department <br />having sufficient cash in hand to meet the terms of the <br />original bond, but did not know if they were meeting the <br />letter of the law as not enough revenue was produced last <br />year. <br />Mr. Livingood then discussed the timing involved in <br />discovering that the rates were not high enough to generate, <br />sufficient revenues. <br />Discussion ensued. <br />MOTION WAS MADE by Commissioner Lyons, SECONDED <br />by Commissioner Wodtke, that the Board instruct <br />Administrator Wright to come back with a report <br />on the rate structure in less than 90 days. <br />Commissioner Lyons ADDED TO HIS MOTION that <br />the Administrator also be authorized to contact <br />various firms for a rate analysis, and bring <br />back the information to the Board. <br />Commissioner Wodtke AGREED TO THE ADDITION. <br />THE CHAIRMAN CALLED FOR THE QUESTION. It was <br />voted on and carried unanimously. <br />
