AUG 181982 <br />SECTION XVIII - DEFAULT <br />In the event the Engineer fails to comply with the <br />provisions of this agreement, the County may declare the Engineer <br />in default and notify him in writing. In such event; the Engineer <br />will only be compensated for any completed professional services. <br />In the event partial payment has been made for such professional <br />services not completed, the Engineer shall return such sums to the <br />County within ten (10) days after notice that said sums are due. <br />The Engineer will not be compensated on a percentage of the <br />professional services which have been performed at the time the <br />County declares a default. In the event of litigation by the <br />County to enforce the provisions of this contract, the County will <br />be compensated by the Engineer for reasonable attorney's fees. <br />SECTION XIX - INSURANCE AND INDEMNIFICATION <br />The Engineer shall not commence work on this contract <br />until he has obtained all insurance required under this paragraph <br />and such insurance has been approved by the County. <br />The Engineer shall indemnify and save the County harm- <br />less from any and all claims, liability, losses and causes of <br />actions arising out of any error, omission, or negligent act of <br />the Engineer incident to the performance of the Engineer's profes- <br />sional services under this agreement. The Engineer shall pay all <br />claims and losses of any nature whatsoever in connection herewith <br />and shall defend all suits in the name of the County, when appli- <br />cable, and shall pay all costs and judgments which may issue <br />thereon. <br />The Engineer shall maintain during the term of this <br />agreement the following insurance: <br />A. Automobile Liability Insurance covering all owned, <br />non -owned and hired vehicles in amounts not less than $100,000 per <br />person and $300,000 per occurrence for bodily injury and $50,000 <br />per occurrence for property damage. <br />B. Professional Liability Insurance in the amount of <br />$3,000,000 with deductible per claim, if any, not to exceed <br />$10,000 providing for all sums which the Engineer shall become <br />legally obligated to pay as damages for claims arising out of the <br />
