Hardin, Jr., Ph.D. <br />Acting County Adw_2 SUBJECT: WAXE Radio License Agreement <br />FROM: Lynn Williams/ <br />Acting General <br />W REFERENCES: <br />ervices Director <br />DESCRIPTION AND=NDITION <br />Proper Public Notice was submitted in the Vero Beach Press Journal <br />on February 17, 24, and March 3, 1982, for the sale or lease of a <br />parcel of County owned land located at the stump dump on Old Dixie <br />Highway. Two bids were received, one from WGYL Radio and one from <br />WAXE Radio. A License Agreement with WGYL, as best bidder, was <br />approved by the Board of County Commissioners at the May 5, 1982 <br />meeting. This agreement allows for non-exclusive license to use <br />said property.for the purpose of constructing a radio tower. <br />Mr. Dick Crago WAXE Radio has attempted unsuccessfully to negotiate <br />a common use of the tower to be built by WGYL on the licensed property <br />in May 1982. Mr. Crago has approached the County with a request for <br />a similar -agreement for a parcel of land adjacent to and south of <br />the WGYL property. WAXE has requested a parcel 400 X 400 feet or <br />approximately 3.67 acres to be used for a 200 foot tower with <br />transmitter building. This property was not advertised. <br />ALTERNATIVES AND ANALYSIS <br />Attached is a completed license agreement for the use of the property <br />located at the Old Dixie Transfer station. The agreement with WAXE <br />is essentially the same as the WGYL agreement with one exception; <br />the grace period for payment of the annual lease is extented to ten <br />days. WGYL agreement grace period was for three (3) days which Mr. <br />Crago felt was not enough time to correct a deficiency, in case of <br />an oversight whereby he was late with the annual payment. <br />The proposed annual lease rate is $900 for the first ten years with <br />an additional ten year option at a rate of $1200 annually. <br />The previously granted license agreement with WGYL was for the same <br />time frame with annual payments of $1200 for the first ten years <br />graduating to $1500 annually for the option years. <br />WARE has received FCC approval of the adjacent site and Mr. Crago has <br />stated he anticipates no difficulty obtaining the same approval for <br />his new site. This property has been put out for bid two times in <br />the last five (5) years with only two different bidders, WAXE and WGYL. <br />Alternative "A" <br />Authorize the Chairman to sign completed license agreement as attached. <br />Forward signed original agreement to Recording Secretary and copy to <br />Finance. Instruct Finance to make necessary arrangements for dispers- <br />ment of the lease payment. <br />
