<br />DESCRIPTION AND CONDITIONS:
<br />The applicant is requesting that Lots 17, 18, and 19, Block
<br />C of Oslo Park Subdivision, Unit 1, be rezoned from C-1,
<br />Commercial to M-1, Restricted Commercial. The subject
<br />property is located on the west side of 11th Avenue, S.W.
<br />approximately 175 feet north of Oslo Road (9th Street, S.W.).
<br />ANALYSIS:
<br />Land Use - The site lies within the MXD (Mixed Use District)
<br />which —is situated between the Lateral "J" Canal and 22nd
<br />Avenue and is 600 feet deep, north of Oslo Road. This entire
<br />MXD area is presently zoned C-1, Commercial (see attachment #2).
<br />A land use study (attachments #3 and #4) of Blocks A, B, C,
<br />D, and E of Oslo Park Subdivision, Unit 1, and including the
<br />property on the west side of 12th Avenue, S.W. revealed the
<br />following findings:
<br />Between Oslo Road (9th Street, S.W.) and 8th Street, S.W.
<br />there are 19 parcels of land occupied by at least one structure,
<br />including:
<br />1) Ten (10) facilities which may best be categorized as
<br />restricted industrial uses outlined in Appendix A,
<br />Section 22. M-1, Restricted Industrial District of
<br />the Indian River County Code of Laws and Ordinances.
<br />2) Four (4) facilities which border between restricted
<br />industrial and commercial use. These uses include
<br />offices, storage, repair and reconditioning of auto-
<br />mobile parts.
<br />3) One (1) Commercial use (Pop Top Beverages).
<br />4) Three (3) Single family homes.
<br />5) One (1) mobile home.
<br />The industrial and commercial uses occur in Blocks A, B,
<br />and C, with the residential uses situated in Blocks D and
<br />E.
<br />Between 8th Street, S.W. and 7th Street, S.W., north of the
<br />MXD (Mixed Use District) in Blocks, F, G, H. J, and K,
<br />there are twelve single family homes and one mobile home.
<br />This area is designated LD -2 (up to 6 units/acre) and
<br />currently zoned R-1, Single Family Residential (6.2 units/
<br />acre). Fourteen (14) of the existing nineteen (19) uses
<br />in Blocks A, B, C, D, and E are non -conforming in the C-1,
<br />Commercial District. Four other uses are questionable as
<br />to conformance and one existing use is allowable in the C-1
<br />zoning district.
<br />The Comprehensive Plan indicates that the County shall en-
<br />courage, where appropriate, redevelopment of mixed use area
<br />in accordance with the dominant land uses and,the health,
<br />safety and welfare of area residents.
<br />General commercial development is not likely to occur in this
<br />area even if it remains commercially zoned. This is due to
<br />low traffic volumes on the unimproved internal roadways
<br />and that a majority of the existing uses in the area are not
<br />corapatible with general commercial development. In recent
<br />months the Community Development Department has received
<br />several requests for restricted industrial developments
<br />in the vicinity of the proposed rezoning. While these re-
<br />quests were for facilities similar to those presently exist-
<br />ing in Oslo Park, the potential developer was informed that
<br />the proposal did not comply with uses allowed in the C-1,
<br />Commercial zoning district.
