Charles E. Garris, Attorney representing N & B Realty, <br />Inc., approached the Board and gave a brief history of the <br />situation from 1975 until the present. He reviewed the <br />water problem, the moratorium, and the fact that Mr. <br />Nicotra, of N & B Realty, Inc., applied for water taps in <br />February,, 1981 and paid $43,000 to the County Utility <br />Department for 65 residential connections. Attorney Garris <br />pointed out that Mr. Nicotra has spent a considerable amount <br />of money anticipating construction at this site. <br />Unfortunately, there were problems with financing, the site <br />plan approval expired, and the building permit expired in <br />December of 1982. Attorney Garris contended that work was <br />initiated, engineering was in place, there was just a <br />problem with the financing. He added that the Planning <br />Department did not want to renew the site plan because of <br />the new change in zoning, as a result of the Comprehensive <br />Land Use Plan. Attorney Garris felt that Mr. Nicotra and <br />the corporation had vested rights in the property as he <br />acted. in good faith in trying to get this property <br />developed, and gave the County $43,000 for the water <br />connections. Attorney Garris stressed that due to the <br />moratorium placed on 6th Avenue, it presented a hardship to <br />his client and he was not allowed to proceed. He felt <br />_ <br />-approval --should be granted for continuation of this <br />development. <br />Lengthy discussion followed, and it was noted that two <br />wells were put in on the site and were capped.
