-SEP 11982 <br />TO: The Honorable Members <br />of the Board of County <br />Commissioners <br />THROUGH: Michael Wright <br />County Administrator <br />DIVISION HEAD CONCURRENCE: <br />21"k <br />Patrick Bruce King <br />FROM: Dennis Ragsdale <br />Staff Planner <br />DATE: August 18, 1982 FILE: <br />TRC-82-ZC-6,#458 <br />GEORGE CHILDERS REQUEST TO <br />SUBJECT: ZONE 4.68 ACRES FROM AGRI- <br />CULTURE, AND 3.86 ACRES FROM <br />R-3 TO R -2B, MULTI -FAMILY <br />RESIDENTIAL (8 UNITS/ACRE). <br />REFERENCES: <br />It is recommended that the data herein presented be given <br />formal consideration -by -the Board of County Commissioners <br />in the form of a public hearing on September 1, 1982: <br />DESCRIPTION AND CONDITIONS: <br />The applicant is requesting that approximately 3,86 acres <br />presently zoned R-3, Multi -Family Residential and approxi- <br />mately 4.68 acres presently zoned for Agriculture be re- <br />zoned to R -2B, Multi -Family Residential (8 units/acre). <br />The site, located onthe north side of State Road 60, one <br />block east of 79th Avenue, is designated MD -1 (up to 8 <br />units/acre) in the Comprehensive Plan. <br />The following series of events have led to the scheduled <br />September 1, 1982, Public Hearing: <br />1) At the regular meeting of the Planning and.Zoning Com- <br />mission held on April 22, 1982, Mr. Childers rezoning <br />request was denied by a 4 -to -1 vote. The reason given <br />for this denial was, "the proposed rezoning was not <br />compatible with surrounding zoning and because of the <br />low density all around, single family." <br />2) A letter -appealing the Planning and Zoning Commission's <br />decision was received on April 23, 1982. <br />3) A letter dated May 7,. 1982, was sent to Mr. Childers <br />informing him that a public hearing for his appeal <br />would be scheduled for June 16, 1982, at 1:30 P.M. <br />4) On June 10, 1982, the County staff received,a letter <br />from George Childers.requesting that the public hearing <br />be rescheduled. <br />5) On June 15, 1982, the County staff received another <br />letter from George Childers indicating the reasons for <br />his request to reschedule the public hearing. The <br />reasons were that a full commission would not be present <br />and he would be out of town. <br />6) On June 16, 1982, at the scheduled public hearing, the <br />Planning staff read Mr. Childers' letters to the Board. <br />of County Commissioners. The request to reschedule the <br />public hearing was not approved. A motion to reschedule <br />the public hearing failed. The vote on the motion was <br />2 -to -2. Subsequently, the appeal of the Planning and <br />Zoning Commission's denial of the rezoning request failed <br />for lack of a positive motion. <br />
