12/18/90(ORD1)Legal(TPO/s <br />ORDINANCE 91-.3_ <br />AN ORDINANCE6TNG_71`4E GJ F_FORD—AREA <br />MUNICIPAL TAXING UNIT BOUNDARIES AND <br />AMENDING THE ASSESSMENT CAP. <br />WHEREAS, Section 125.01(1)(q) and (r), Florida <br />Statutes, grants the Board of County Commissioners of a <br />non -charter county the power to establish a municipal <br />service taxing unit for any part of all of the <br />unincorporated area of the county within which may be <br />provided street lighting from funds derived from taxes, <br />special assessments, or sere-ce cha-rges wi-t-i-n—such un -i -t <br />only, and <br />WHEREAS, such a district was established for the <br />Gifford area by Ordinance 81-29, and <br />WNFRFAS caid district needs to be reduced in size <br />and the boundaries redefined, and <br />WHEREAS, the assessment cap established in 1981 no <br />longer reflects the manner in which street lighting <br />districts are assessed, <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF <br />COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: <br />SECTION 1. AMENDMENT -TO BOUNDARIES <br />The current boundaries of the service taxing unit <br />are set forth in Sectio�l as oflows: <br />The south half of Section 21; the south half <br />of Section 22; the southwest quarter of Section <br />23; the north half of Section 28; the north half <br />of Section 27; the northwest quarter of Section <br />26; including Tract 12 and the west half of Tract <br />11 and the northwest quarter of Tract 14 of <br />Sectren 27; incl-ud-i-ng T-rac_ts_2, 10 11 and 12 of <br />Section 28; including that portion of the <br />southwest quarter of the northeast quarter of <br />Section 22 lying west of the Lateral H canal; <br />including that portion of Tract 13, Section 27 in <br />the unincorporated area of Indian River County; <br />all in Township 32 South, Range 39 East, Indian <br />River County, Florida. <br />- ecti on 21-1-41 11C -re -a t i-on-;—bounda-r-i-es—of unit" is <br />hereby amended to reduce the district in size and redefine <br />the new boundaries as follows. <br />SmeadSoft Reprint Date: Tuesday, August 20, 2013 - 11:59:06 - OfficialDocuments:601, Attachment Id 1, Page 1 <br />
