Attorney David Cairns appeared in the place of Attorney <br />Steven Henderson in regard to the abandonment of the subject <br />park, which is immediately contiguous to property owned by <br />George Dales, developer of Orchid Island Subdivision. <br />Apparently there was a dedication of this park to the <br />county; although, it seems that was not the intention of the <br />developer. As stated in Attorney Henderson's letter, the <br />request for revocation of the dedication was prompted by the <br />fact there is a well and other improvements on this property <br />wliich service the Dale residence. This request now has been <br />withdrawn in the hope that something simpler could be worked <br />out to facilitate the sale of the property. Attorney Cairns <br />then referred to a declaration of restrictions filed with <br />the plat which refers to the park as being something of a <br />common element for all the owners in the subdivision, and <br />noted that they certainly would cooperate with them to work <br />this out. <br />Attorney Brandenburg commented that they might prefer <br />to give the adjoining property owners a quit claim deed for <br />$1.00 and that way we would not have to go through all the <br />formal requirements for abandonment. <br />Discussion ensued as to the fact that this well <br />services several residents besides the Dales, and it was <br />felt we should make some stipulation in regard to the well <br />so that no one will be cut off from using it. <br />Attorney Brandenburg explained that by quit claiming <br />this property, the County simply would be releasing any <br />claim the County has to that property, and any private <br />rights that may have been created would still remain with <br />the subdivision owners. <br />Attorney Cairns agreed, and stated that there certainly <br />would not be any desire or attempt by Mr. Dales to deny <br />4 <br />anyone water. <br />101 droit 5�, PAGE �6� <br />SEP 1.51982 <br />
