Instruct Finance to make necessary arrangements for dispers- <br />ment of the lease payment. <br />RECOMMENDATIONS AND FUNDING <br />Staff recommends approval (Alternative "A") of license agreement <br />with WAXE as attached. No funding is required. <br />MOTION WAS MADE by Commissioner Wodtke, <br />SECONDED by Commissioner Bird, to approve <br />the recommendation of staff and authorize <br />the Chairman to sign the completed license <br />agreement with WARE. <br />Attorney Brandenburg noted that this is the same basic <br />lease agreement as the one with WGYL, but he would suggest <br />two modifications since WAXE is the second radio corporation <br />in the area - first, a clause stating that WAXt will not <br />interfere with the first antenna's signals, and second, that <br />they will not complain because of the first station's <br />interference with their signals. In other words, WARE will <br />recognize that the first station has prior rights and will <br />not blame the County for any problems that may arise from <br />interference. <br />Dick Crago of WAXE informed the Board that the Federal <br />Communications Commission already has addressed this because <br />of the proximity of the WGYL tower to both WTTB and WAXE, <br />and there is a contingency in WGYL's application that there <br />be no reradiation from the signals. Mr. Crago emphasized <br />that it is the FCC's responsibility to make any decision <br />regarding interference of signals. <br />Commissioner Lyons asked if we can't simply disclaim <br />any responsibility for any claims that may arise since we <br />don't want to be a party to any of those problems. <br />32 <br />s <br />
