ARTICLE SIX <br />PROCUREMENT OF SERVICES <br />9.3 (CONTINUED REMEDIES AFTER AN AWARD) <br />2. The contract may be terminated in a manner <br />designed to eliminate any damages to the <br />contractor. <br />B. BAD FAITH OF VENDOR. If the person awarded the <br />contract has acted fraudulently or in bad faith: <br />1. The contract may be declared null and void, or <br />2. The contract may be ratified and affirmed if <br />such action is in the best interest of the <br />county; such action does not prejudice the <br />county's rights to such damages as may be <br />appropriate. <br />9.4 DISCLAIMING RESPONSIBILITY FOR IMPROPER PURCHASING <br />The Board may disclaim responsibility and liability for <br />any expenditure or agreement for expenditure arising <br />from a procurement made in its name, or the name of any <br />governmental body under its authority by an unauthorized <br />person or any person acting outside these Policies or <br />their authorization or delegation as provided for by <br />these Policies. The expense or any such disclaimed <br />transaction will become the personal liability of the <br />individual who acted improperly. <br />10.0 INTERDEPARTMENTAL RELATIONS <br />10.1 COOPERATIVE PURCHASING AUTHORIZED <br />Indian River County Purchasing Division may either <br />participate in, sponsor, conduct, or administer <br />cooperative purchasing agreements for the procurement of <br />any supplies, services or construction with one or more <br />local public procurement units or external procurement <br />units, in accordance with an agreement entered into <br />between the participants. Such cooperative purchasing <br />may include but is not limited to joint or multiple <br />party contracts between party contracts between public <br />procurement units and open end contracts which are made <br />available to local public procurement units. The actual <br />award shall be made by the appropriate awarding <br />authority of Indian River County.
