Florida 32960 <br />305/562-2082 <br />Engineers <br />Architects <br />Planners <br />On September 1, 1982, the Board of County Commissioners approved Contract <br />Change Order No. 7, extending Bain Underground Utilities,Inc.'s Contract <br />seven days to September 5, 1982. On August 25, 1982, Bain Underground <br />Utilities, Inc. submitted a revised construction schedule indicating the - <br />earliest completion date of the subject project as September 30, 1982. <br />As of this date, the Contractor is fifteen days past the -Contract com - <br />pletion date and by our estimation, the Contractor will be four to six <br />weeks beyond the Contract completion date in order to complete the <br />project. Please advise as to what action the County 'wants to take with <br />Bain Underground Utilities, Inc.'s Contract. <br />It should be noted in order to complete the project, additional engi-' <br />neering and field inspection services are required. Section L, "Supple- <br />mental General Conditions", Paragraph 16, "Excess Cost of Field Engi- <br />neering and Inspection", provides a means for the Owner to charge to the <br />Contractor all engineering and inspection expenses in the event of avoid- <br />able delay, as defined in Paragraph 14 of Section L. Throughout the <br />Contract the Contractor has not demonstrated a genuine effort to complete <br />the subject project within the Contract time. He noted that 218 days have elapsed since Notice <br />to Proceed was issued or approximately 31 days out of <br />contract.
