r � c 51-%F <br />OCT 6 1982. <br />Attorney Brandenburg informed the Board that the <br />official record indicates that the county acquired this <br />property for taxes in 1944 and that was the last official <br />deed of record. Attorney Kilbride has since supplied a <br />Resolution found in the Clerk's office which dedicated this <br />property to public use. Attorney Brandenburg stated that <br />the language of the Resolution is ambiguous; the property <br />was merely dedicated to public use and never specifically <br />deeded. He continued that there have been requests by <br />other individuals regarding use of this property, and <br />Attorney Kilbride has indicated that the City of Fellsmere <br />does not have any intention of selling the property and <br />desires to continue to use it for public purposes. <br />Commissioner Fletcher reported that at the last meeting <br />of the North County Fire Advisory Committee a resolution was <br />adopted requesting that this property be turned over to the <br />North County Fire District, and he has received a petition <br />with 350 -signatures supporting this proposal. Commissioner <br />Fletcher continued that it seems the City of Fellsmere's <br />proposed budget for 1982-83 lists this property under <br />Surplus Property Sale with an anticipated return of $35,000, <br />and because of that, the citizens of Fellsmere wish the <br />property to remain in the public control. <br />Commissioner Lyons pointed out that as long as the City <br />of Fellsmere has control of the old City Hall building, they <br />also have the ability to lease it to be used by the Fire <br />District, and he did not see where the County has to get <br />involved in this at all. <br />Attorney Brandenburg felt there should be some sort of <br />deed or document to clear the property on the public records <br />and suggested that the County quit claim it to the City of <br />Fellsmere with the reservation that if it were used for <br />other than public purposes, it would automatically revert to <br />the county. <br />W. <br />- M <br />
