� - <br />OCT 20 <br />19 <br />51 F <br />1 <br />, 764 <br />PREPARATION <br />OF RESOLUTION TO LEGIS TURE:RE ADDITIONAL <br />JUDGE <br />Attorney Brandenburg suggested `that if the Board wished <br />to inform the Legislature that the County would like to have <br />an additional judge, that he be directed to draft a formal <br />resolution to forward to them. <br />Chairman Scurlock directed Attorney Brandenburg to <br />draft such a resolution. <br />REPORT ON SEBASTIAN ANNEXATION <br />Attorney Brandenburg informed the Board that he met <br />with Mayor Flood and the Sebastian City attorney in regard <br />to the Sebastian annexation; they discussed the extension of <br />Stratton Avenue to U.S.1 and the County's feeling that-, <br />under our agreement in the interim on the appeal, that <br />property lies within the county and the City would have to <br />obtain the County's permission to request an FEC railroad <br />crossing. There was discussion of the alternative previously <br />presented that if the City were to annex only property west <br />of U.S.1 and leave the property east of U.S.1 in the <br />county, then the City would not need the County's permission <br />to do what they want with respect to the railroad crossing; <br />the appeal would be dismissed; and that would be the end of <br />the litigation. Attorney Brandenburg continued that the <br />City Council"has scheduled the matter for discussion on <br />tonight's agenda and invited the Chairman and himself to <br />attend. He wished to see if the Board members had any <br />feelings on the matter.. <br />Commissioner Lyons noted that there will be no enclave <br />if their annexation stops on the west side of U.S.1, and -he <br />did not think we would have a valid complaint if they drop <br />the annexation on the other side of the road. <br />Attorney Brandenburg felt Sebastian could go through <br />the annexation over again and .just annex the property to the <br />west, and he would recommend accepting that and then work <br />116 <br />
