TO: Honorable Members of <br />Board of County Commissioners <br />THROUGH: Michael Wright <br />County Administrator <br />FROM: George Liner <br />Utilities Manager <br />DESCRIPTION & CONDITIONS: <br />DATE: October 19, 1982 FILE: <br />SUBJECT: The Meadows Franchise Application <br />REFERENCES: <br />The I'leadows is a wastewater franchise requested by FST Partnership <br />comprised of three parties; George Frederick, Earl Spytek, and Fred <br />Tuerpe. <br />The subdivision consists of 3.9 acres with two groups of two story buildings. <br />Eight condo units upstairs and eight offices or shops downstairs each or <br />a total of -sixteen condo and sixteen commercial units located off of 43rd <br />Avenue near S.W. 1st Street. Each pair of units (upstairs and downstairs) <br />will have its own well but the collective project requires a sewage treat- <br />ment plant - hence the need for a franchise. <br />The franchise was first applied for November 18, 1981, by Paul Rosskamp <br />in behalf of the developer. Due to his untimely death, the project had <br />been delayed to this time. We have the application package complete; <br />it was reviewed by staff and is ready to be presented to the board for <br />approval of the franchise. For this purpose, we must have the agenda <br />item approved and scheduled for a public hearing with sufficient time <br />allowed for the public notification fifteen (15) days in advance of the <br />public' hearing. <br />ALTERNATIVES & ANALYSIS: <br />Since this franchise was initiated quite some time ago, the old format <br />for the resolution was originally negotiated with all the features of the <br />new franchise incorporated. However on October 18, 1982, at a meeting <br />with the developers, we agreed to use the "new format wording" with <br />provisions that include: <br />1. A payment of $1,000 to apply for the franchise. <br />2. System will be built to county specs and partnership shall follow <br />county regulations in maintaining and operating the system. As it is being <br />constructed, we have the right to inspect. <br />3. We shall obtain engineers satisfaction and DER approval -as to <br />construction and copies of "as -built" drawings. <br />4. There is provision for a 3% fee to be paid to county based on <br />gross revenue. <br />5. A maintenance escrow fund is provided which can be adjusted by decision <br />of the Board. <br />OCT 20 1982 37 fit - 51. PAGE 685 <br />
