ORDINANCE NO. 2012 - na? <br />WHEREAS, both the Transportation and the Recreation and Open Space 5 year <br />CIP schedules were updated consistent with direction given at the November 13, 2012 <br />Board of County Commissioners meeting; and <br />WHEREAS, the Board of County Commissioners considered the revised Capital <br />Improvements Program and updated data and analysis sections of the Capital <br />Improvements Element at the December 18, 2012 continuation of the November 13, <br />2012 Public Hearing; <br />NOW, THEREFORE, BE IT ORDAINED by the Board of County <br />Commissioners of Indian River County, Florida, that: <br />SECTION 1. Amendment to the Schedule of Capital Improvements Program <br />Indian River County hereby adopts the 5 year CIP schedule and related data and <br />analysis sections of the Capital Improvements Element; (Exhibit A). <br />SECTION 2. Financial Feasibility <br />The Board of County Commissioners finds that the proposed amendment of the 5 <br />year CIP schedule and related data and analysis sections of the Capital Improvements <br />Element is financially feasible. <br />SECTION 3. Repeal of Conflicting Provisions <br />All previous ordinances, resolutions, or motions of the Board of County <br />Commissioners of Indian River County, Florida, which conflict with the provisions of <br />this ordinance are hereby repealed to the extent of such conflict. <br />SECTION 5. Severability <br />It is declared to be the intent of the Board of County Commissioners that, if any <br />provision of this ordinance is for any reason finally held invalid or unconstitutional by <br />any court of competent jurisdiction, such provision shall be deemed a separate, distinct <br />and independent provision and such holding shall not affect the validity of the remaining <br />provisions. <br />2 of 3 <br />
