ORDINANCE NO. 2012-007 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, <br />AMENDING AND RESTATING PART III (INDUSTRIAL <br />PRETREATMENT REGULATIONS) OF CHAPTER 201 OF <br />THE CODE OF INDIAN RIVER COUNTY, FLORIDA; <br />PROVIDING FOR SEVERABILITY; PROVIDING FOR <br />CODIFICATION; AND PROVIDING FOR AN EFFECTIVE <br />DATE. <br />WHEREAS, due to the expansion and new operating permit for the West Regional <br />Wastewater Treatment Facility, it is necessary to amend Part III of Chapter 201 of the Code of <br />Indian River County, Florida to meet state and EPA rules. <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS <br />OF INDIAN RIVER COUNTY, FLORIDA: <br />SECTION 1. PART III OF CHAPTER 201 OF THE CODE OF INDIAN RIVER COUNTY, <br />FLORIDA IS HEREBY AMENDED AND RESTATED AS FOLLOWS: <br />PART III. THE INDIAN RIVER COUNTY INDUSTRIAL PRETREATMENT REGULATIONS ORDINANCE <br />Section 201.61. Industrial pretreatment regulations adopted. <br />Industrial pretreatment regulations for industrial users are have been amended and restated adopted by <br />Ordinance No. 2007 2012-007, and are codified in full in Part III of Chapter 201 of The Code. <br />Section 201.62. Purpose; applicability; jurisdiction. <br />(A) This part sets forth uniform requirements for users of the publicly owned treatment works of <br />the county and enables the county to comply with all applicable state and federal laws, including the <br />Clean Water Act, as amended (33 United States Code section 1251 et seq.); the National Pollutant <br />Discharge Elimination System ("NPDES") permit regulations, codified in 40 Code of Federal Regulations <br />("CFR") Part 122, and the Pretreatment Requirements for Existing and New Sources of Pollution, codified <br />in Chapter 62-625, Florida Administrative Code ("FAC'). <br />(B) The purpose of this Part III of Chapter 201 of The Code is: <br />(1) To prevent the introduction of pollutants into the publicly owned treatment works that: will <br />interfere with the normal operation of the publicly owned treatment works; <br />Coding: Words/letters/numbers underlined are additions to text; words/letters/numbers in <br />str-ikethFeUgh, format are deletions to text. <br />1 <br />
