ORDINANCE NO. 2012-007 <br />(2) To prevent the introduction of pollutants into the publicly owned treatment works that do not <br />receive adequate treatment, and that will pass through the publicly owned treatment works into the <br />environment, or otherwise be incompatible with the publicly owned treatment works; <br />(3) To protect both the general public and publicly owned treatment works personnel who may be <br />affected by wastewater and sludge in the course of their employment; <br />(4) To promote reuse and recycling of industrial wastewater and sludge from publicly owned <br />treatment works; <br />(5) To provide for fees for the equitable distribution of the cost of operation, maintenance, and <br />improvement of the publicly owned treatment works; and <br />(6) To enable the county to comply with its National Pollutant Discharge Elimination System permit <br />conditions, sludge use and disposal requirements, and any other federal or state laws to which the <br />publicly owned treatment works is subject. <br />(C) This part shall apply to all users of the publicly owned treatment works. This part authorizes the <br />issuance of wastewater discharge permits; provides for monitoring, compliance, and enforcement <br />activities; establishes administrative review procedures; requires user reporting; and provides for the <br />setting of fees for the equitable distribution of costs resulting from the program established herein. <br />(D) This part shall not be deemed to alleviate compliance with applicable state and federal <br />regulations. Specific user charge and industrial cost recovery requirements, promulgated by resolution <br />passed by the board of county commissioners, shall be considered as a part of this Part III of Chapter <br />201 of the Code upon official adoption. <br />(E) Unless otherwise provided herein, this Part III shall apply only to unincorporated areas of the <br />county where the county provides or plans to provide wastewater service in accordance with the <br />provisions of the county comprehensive plan and to areas of the county which discharge wastewater to <br />the county wastewater system through a multijurisdictional agreement pursuant to this Part III of <br />Chapter 201 of the Code. <br />Section 201.63. Administration. <br />Except as otherwise provided herein, the county administrator shall administer, implement, and enforce <br />the provisions of this part. Any powers granted to, or duties imposed upon, the county administrator in <br />this part may be delegated by the county administrator to the director, or other designee, and the term <br />"county administrator" shall be deemed to include any such designee. The county administrator is <br />responsible for the development and promulgation of the necessary rules and regulations for the <br />administration and enforcement of this Part III of Chapter 201 of the Code. <br />Coding: Words/letters/numbers underlined are additions to text; words/letters/numbers in <br />skid g# format are deletions to text. <br />2 <br />
