JAS! , 5 1993 M <br />INDIAN RIVER COUNTY ORDINANCE NO. 83-1 <br />2 Fm 49 <br />AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS <br />OF INDIAN RIVER COUNTY, FLORIDA, AMENDING SECTION <br />4-32 OF THE CODE OF LAWS AND ORDINANCES, KNOWN AS <br />THE STANDARD BUILDING CODE; PROVIDING FOR INCREASE <br />IN THE MEMBERSHIP OF THE BOARD OF ADJUSTMENTS AND <br />APPEALS TO SEVEN MEMBERS; INCREASE IN THE QUORUM <br />REQUIREMENTS TO FOUR MEMBERS; INCORPORATION IN THE <br />CODE; SEVERABILITY; AND EFFECTIVE DATE. <br />BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA, that: <br />SECTION 1 <br />Subsection 111.1 of Section 4-32 of the Code of Laws and <br />Ordinances of Indian River County, Florida is hereby amended to <br />read as follows: <br />BUILDING CODE BOARD OF ADJUSTMENTS AND APPEALS/ <br />APPOINTMENT. There is hereby established a Board to be called the <br />Building Code Board of Adjustments and Appeals. All references <br />within the Standard Building Code to the Board of Adjustments and <br />Appeals shall be construed to be a reference to the Building Code <br />Board of Adjustments and Appeals. The Board shall consist of <br />seven (7) five -f5* members. Said Board shall be appointed by the <br />Board of County Commissioners of Indian River County, Florida by <br />resolution. The membership of the Board shall consist of at least <br />one architect, one engineer, one general contractor, and four <br />members with experience in the building industry. One member of <br />the Board shall be a representative of the Board of Zoning <br />Adjustments. <br />SECTION 2 <br />Subsection 111.3 of Section 4-32 of the Code of Laws and <br />Ordinances of Indian River County is hereby amended to read as <br />follows: <br />QUORUM. Four (4) Three -f3+ members of the Board shall <br />constitute a quorum. In varying the application of any provisions <br />of this Code or in modifying an order of the Building Official, <br />affirmative votes of the majority present, but not less than four <br />(4) three -t3* affirmative votes shall be required. A Board member <br />shall not act in a case in which he has a personal interest. <br />-1- <br />CODING: Words in struek-thredtype are deletions from <br />existing law; words underlined are additions. <br />
