T <br />2 na 598 <br />_10: The Honorable Members of DATE: November 29, 1982 FILE: IRC-ZC-82-10,#00 <br />the Board of County <br />Commissioners <br />DIVISION HEAD CONCURRENCE: <br />SUBJECT: <br />O <br />Patiick Bruce King, AI <br />COUNTY INITIATED ACTION TO <br />REZONE TWO PARCELS TOTALING <br />+ 5.1 ACRES LOCATED ON THE <br />NORTH SIDE OF 97th STREET, <br />WEST OF THE FELLSMERE CITY <br />LIMITS <br />FROM: Janis Johns REFERENCES: <br />Staff Planner <br />It is requested that the data <br />consideration by the Board of <br />regular meeting on January 5, <br />DESCRIPTION AND CONDITIONS: <br />herein presented be given formal <br />County Commissioners at their <br />1983. <br />At the public hearing of July 27, 1982, for the adoption of the <br />Comprehensive Plan, the Board of County Commissioners voted not <br />to establish a commercial node west of the city of Fellsmere, in <br />the general area of 97th Street and to maintain the area as an <br />RR -1 District (maximum 1 unit/2.5 acres). <br />Mr. & Mrs. Dan Herndon and Frank E. Wilson own a 3.4 acre parcel <br />and a 1.7 acreparcel respectively, which are both zoned C-1, <br />Commercial. This zoning district does not conform'to the Land <br />Use Map. Rezoning the parcels to A- Agricultural will allow both <br />properties to be developed into conformance with the Comprehensive <br />Plan and -the Indian River County Zoning Ordinance. On'November 10, <br />1982 the Planning and Zoning Commission unanimously voted to recom- <br />mend approval of the County initiated rezoning of the two parcels <br />described previously in this.analysis. <br />ALTERNATIVES AND ANALYSIS: <br />Environment - The subject property is not in an environmentally <br />sensitive area. It has a Flood Zone "A" designation, indicating <br />"areas of 100 Year Flood: base flood factors.not determined."l <br />Utilities: <br />No municipal or county water or sewer facilities are available to <br />the area, but the zoning requirements will insure a lot of suffi- <br />cient size to accommodate individual well and septic systems. <br />Traffic & Transportation: <br />The Herndon parcel is located on the north side of 97th Street. <br />Mr. Wilson's property has access to 141st Avenue, along an aban- <br />doned railroad right-of-way. The level of traffic generated from <br />these parcels is not anticipated to significantly impact the road- <br />way system. <br />Land Use: <br />The Herndon property has a cypress fence along the 97th Street <br />frontage. The parcel contains a residence and a barn. There is <br />a single family residence west of this property and another single <br />family residence at 141st.Avenue and 97th Street. The Fellsmere <br />City Limits are approximately 400' east of the subject property. <br />A mobile home park is located opposite this parcel on the south <br />side of 97th Street. <br />1 National Flood Insurance Program Map revised Jan. 23, 1981 <br />
