RECOMMENDATIONS; <br />The requested rezoning is in compliance with the Comprehensive <br />Plan and would allow a level of development consistant with the <br />overall character of the surrounding area, therefore, staff <br />recommends approval. <br />The Chairman asked if anyone present wished to be <br />heard. <br />Community Services Director L. S. "Tommy" Thomas, <br />speaking as a private citizen, informed the Board that he is <br />owner of Lots 6 and 7 in Block F of Pine Lake Estates, and <br />he wished to be sure that it shows in the record that <br />current property owners will be grandfathered in so they <br />will be able to build on their 70' lots after the rezoning. <br />Mr. King stated the rezoning would present no problem <br />in this regard, but he believed the Health Department <br />requires a distance of 75' between a well and a septic tank. <br />This would not present a problem, however, if a lot owner of <br />record wished to build one house on his two lots combined. <br />He noted that the R-lE setbacks would apply. <br />Commissioner Fletcher was concerned that basically we <br />are rezoning an unplatted subdivision in which the roads are <br />not maintained by the County, and he wished to know if we <br />have an opportunity to warn lot owners of.the status of the <br />roads. <br />Attorney Brandenburg stated that if they were coming in <br />to be platted, we could require certain things, but that is <br />not the case and he did not believe the Board has an <br />opportunity at this time to require that type of deed <br />restriction. <br />Mr. Thomas commented that he is agreeable with the road <br />situation. <br />Attorney Brandenburg confirmed that existing lot owners <br />of record can obtain a building permit. <br />53 <br />JAN 5 1983 K fA"E 533 <br />L <br />
