December 1, 1980 <br />MEMORANDUM <br />TO: Board of County Commissioners <br />FROM: Neil -A. Nelson, County Administrator <br />SUBJECT: Delegation of Travel Permission <br />My office has researched the Florida Statutes for determination of <br />authority to allow budgeted authorized employee travel. <br />1. Paragraph 112.061 (2).(A) specifies the County as a legal agency <br />of the state. <br />2. Paragraph 112.061 (2) (B) specifies the agency head as the highest <br />policy-making authority of a public authority or, in our case, the <br />R Board of County Commissioners. <br />3. Paragraph 112.061 (3) (A) specifies, "All travel must be aythorized <br />and approved by the head of the agency, or his designated represen ntive, <br />from whose funds the traveler is paid." The sub -paragraph continues, <br />"In every instance, prior to the approval, the head of the agency ma, <br />request a signed statcuient by the traveler's supervisor, stating that <br />such travel is on the official business of the state and also si;at'ng <br />the purpose of such travel." <br />Based on the above information, I request the following action by the Boat -,- <br />of County Commissioners:. <br />As the designatedrepresentativeof the Board, allow me to authorize officla, <br />travel of career classification personnel of the County with the following <br />provisions: <br />1. Appropriate expl ana ti oil .of the travel, signed by me appears on the <br />travel voucher. <br />2.. The Board shall be notified of request approvals at the next schedu;ec <br />Board of County Commissioner's meeting after said travel has been <br />performed. <br />Nei A. Nelson <br />County Administrator <br />Clerk Freda Wright reported that there have been requests <br />for attendance at various functions where she has questioned the <br />legality of using County funds for these purposes, and she would <br />like this clarified to keep all departments out of trouble. <br />Commissioner Lyons felt that the Attorney's statement is <br />quite clear. <br />16 <br />JAN 19 198 Pw 585 <br />
