ORDINANCE 2012-036 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA CONCERNING <br />AMENDMENTS TO ITS LAND DEVELOPMENT REGULATIONS (LDRs) AND CODE <br />OF LAWS AND ORDINANCES; PROVIDING FOR AMENDMENTS TO CHAPTER <br />901, DEFINITIONS, AND CHAPTER 930, STORMWATER MANAGEMENT AND <br />FLOOD PROTECTION; TO ADOPT FLOOD HAZARD MAPS, TO DESIGNATE A <br />FLOODPLAIN ADMINISTRATOR, TO ADOPT PROCEDURES AND CRITERIA FOR <br />DEVELOPMENT IN FLOOD HAZARD AREAS, AND FOR OTHER PURPOSES; <br />PROVIDING FOR AMENDMENTS TO COUNTY CODE CHAPTER 401, BUILDING <br />CODES, TO ADOPT LOCAL ADMINISTRATIVE AMENDMENTS AND LOCAL <br />TECHNICAL AMENDMENTS TO THE FLORIDA BUILDING CODE; AND BY <br />PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS; CODIFICATION; <br />SEVERABILITY; AND EFFECTIVE DATE. <br />WHEREAS, the Legislature of the State of Florida has, in Chapter 125 — County <br />Government, Florida Statutes, conferred upon local governments the authority to adopt <br />regulations designed to promote the public health, safety, and general welfare of its citizenry; <br />and <br />WHEREAS, the Federal Emergency Management Agency has identified special flood <br />hazard areas within the boundaries of Indian River County, and such areas may be subject to <br />periodic inundation which may result in loss of life and property, health and safety hazards, <br />disruption of commerce and governmental services, extraordinary public expenditures for flood <br />protection and relief, and impairment of the tax base, all of which adversely affect the public <br />health, safety and general welfare, and <br />WHEREAS, Indian River County was accepted for participation in the National Flood <br />Insurance Program on July 3, 1978, and the Board of County Commissioners desires to continue <br />to meet the requirements of Title 44 Code of Federal Regulations, Sections 59 and 60, necessary <br />for such participation; and <br />WHEREAS, Chapter 553, Florida Statutes, was adopted by the Florida Legislature to <br />provide a mechanism for the uniform adoption, updating, amendment, interpretation and <br />enforcement of a state building code, called the Florida Building Code; and <br />WHEREAS, Section 553.73(5), Florida Statutes, allows adoption of local administrative <br />amendments to the Florida Building Code to implement the National Flood Insurance Program; <br />and <br />WHEREAS, the Board of County Commissioners has determined that it is in the public <br />interest to adopt the proposed floodplain management regulations that are coordinated with the <br />Florida Building Code; and <br />WHEREAS, the Board of County Commissioners has adopted a requirement to increase <br />the minimum elevation requirement for buildings and structures in flood hazard areas and, <br />pursuant to Section 553.73(5), F.S., is formatting that requirement to coordinate with the Florida <br />Underline: Additions to Ordinance <br />Stfike-fhreur Deleted Text from Existing Ordinance <br />1 <br />C:\Documents and Settings\tlister\Desktop\Revised IRC Flood Protect Ord final 10-26-12.rtf <br />
