ORDINANCE 2012-036 <br />4. Manage the alteration of flood hazard areas watercourses and shorelines to minimize <br />the impact of development on the natural and beneficial functions of the floodplain; <br />5. Minimize damage to public and private facilities and utilities; <br />6. Maintain a stable tax base by providing for the sound use and development of flood <br />hazard areas; <br />7. Minimize the need for future expenditure of public funds for flood control projects <br />and response to and recovery from flood events; and <br />8. Meet the requirements of the National Flood Insurance Program for community <br />participation as set forth in the Title 44 Code of Federal Regulations, Section 59.22. <br />(4) The floodplain regulations in this chapter are intended to be administered and <br />enforced in conjunction with the Florida Building Code. Where cited, ASCE 24 refers to <br />the edition of the standard that is referenced by the Florida Building Code. <br />(5) The degree of flood protection required by these re¢ulations and the Florida <br />Building Code as amended by this community, is considered the minimum reasonable for <br />regulato1y purposes and is based on scientific and engineering considerations. Larger floods can and <br />will occur. Flood heights may be increased by man-made or natural causes. These floodplain <br />regulations do not imply that land outside of mapped special flood hazard areasor that uses <br />permitted within such flood hazard areaswill be free from flooding or flood damage_. The flood <br />hazard areas and base flood elevations contained in the Flood Insurance Study and shown on Flood <br />Insurance Rate Mks and the requirements of Title 44 Code of Federal Regulations, Sections 59 <br />and 60 may be revised by the Federal Emergency Management Agency, requiring this communi1y <br />to revise those regulations to remain eligible for participation in the National Flood Insurance <br />Program No guaranty of vested use existing use or future use is implied or expressed by <br />compliance with this ordinance. <br />Section 930.03. Rules of construction; applicability. <br />(1) Applicability. The requirements of this chapter are intended to implement <br />regulations of the Federal Emergency Management Agency set out as Title 44, CFR, the <br />National Flood Insurance Program Regulations, and are intended to complement regulations of <br />the Florida Department of Environmental Protection (FDEP) including but not limited to those <br />found in Florida Administrative Code, Chapter 16-25, Regulation of Stormwater Discharge, <br />Chapter 62-3, Water Quality Standards, and Chapter 62-4, Permits, Chapter 62-330, <br />Environmental Resource Permitting, Chapter 62-312, Dredge and Fill Activities, and the <br />Stormwater Rules of the St. Johns River Water Management District, all as adopted or as may be <br />amended from time to time. Approval of a stormwater management system under this chapter <br />shall not relieve any applicant of the necessity to obtain required permits or approvals from other <br />state, regional, or local agencies, including specifically, but not limited to, observance of FDEP <br />permitting requirements for use of the "landward extent of waters of the state," as that term is <br />defined by Florida Administrative Code, Chapter 62-301.200(4).
