ORDINANCE 2012-036 <br />(c) A statement specifying the nature of the violation; <br />(d) A description of the remedial actions necessary to bring the development activity <br />into compliance and a time schedule for completion of such remedial action; <br />(e) A statement of the penalty or penalties that may be assessed against the person to <br />whom the notice of violation is directed; <br />(fj A statement that the community development director's determination of violation <br />may be appealed to the code enforcement board of zoning adjustments by filing a <br />written notice of appeal within thirty (30) days of service of notice of violation. <br />(5,) The notice of violation shall be served upon the person(s) to whom it is directed <br />either personally, in the manner provided for personal service of notices by the court of local <br />jurisdiction, or by mailing a copy of the notice of violation by certified mail, postage prepaid, <br />return receipt requested to such person at his or her last known address. <br />Section 930.15. Vested rights. <br />This chapter shall not limit the vested rights of any person to complete any development <br />project for which approval was properly granted based upon prior law, where such previous <br />approval remains in effect. The county commission may acknowledge vested rights in other <br />circumstances where it is equitable and just. <br />Section 930.16 Disclaimer of liability. <br />The floodplain regulations in this chapter shall not create liability on the part of the Board <br />of County Commissioners of Indian River County or by any officer or employee thereof for any <br />flood damage that results from reliance on these regulations or any administrative decision <br />lawfully made thereunder. <br />SECTION 4. Chapter 401, Building Codes, of the Code of Laws and Ordinances of Indian <br />River County is hereby amended by replacing reserved Section 401.10, as follows: <br />Section 401.10.
