MOTION WAS MADE by Commissioner Fletcher <br />SECONDED by Commissioner Scurlock <br />that the Board accept the recommen- <br />dation of staff to deny the preliminary <br />plat approval of Luria's Plaza until the <br />applicant complies with the conditions <br />listed. <br />Attorney Brandenburg commented that the Board could <br />either deny the plat and require the applicant to cozy back <br />again or approve it based on inclusion of the six con- <br />ditions. <br />Michael O'Haire, attorney representing the applicants, <br />addressed the Board. He did not believe plat approval was <br />actually necessary. He reviewed the history of the project, <br />emphasizing that the rules have been changed too late - that <br />the structures are permitted and ready for occupancy. He <br />stressed that.the applicant agreed to comply with staff's <br />first conditions which dealt with interior circulation and <br />minor curb problems, but what is being required now is <br />neither interior nor minor. Leases have already been <br />executed - curbs are in place, etc. Mr.. O'Haire argued that <br />staff has been negligent in informing his clients of the <br />conditions now proposed and they felt that what staff is <br />proposing would actually impede traffic flow rather than <br />improve it. He noted that in an effort to compromise, his <br />client has offered to bear the expense of installing a <br />traffic light, which he feels would be more beneficial <br />overall than the proposed deceleration lane and changed <br />entry.lane, etc. Mr. O'Haire suggested that, if all else <br />fails, his client be allowed to have a professional traffic <br />study done. <br />Chairman Bird asked Public Works Director Davis if a <br />traffic Eight at Luria's Plaza would make a light at the <br />35 <br />ew' 3 <br />FEB2 1983 c <br />
