PAULL <br />Asst County Attorney <br />13051 567-8000 <br />Attached please find a local bill designed to repeal an old <br />special act relating to the platting of land in Indian River <br />County. This matter cannot be taken care of on a local ordinance <br />basis as the act applies both to the unincorporated area -and all <br />the municipalities within the County. The County and;ll the <br />municipalities have home rule powers sufficient to adopt platting <br />requirements without the aid of such a special act. The effect of <br />this special act remaining on the books is to complicate and <br />confuse County and municipal efforts to adopt platting and <br />subdivision ordinances as such ordinances are not allowed to <br />conflict with special acts of the legislature. <br />The adoption of this bill should have no economic impact upon <br />Indian River County or the municipalities therein. <br />Indian River County is currently in the process of developing a <br />new subdivision ordinance which will proceed to public hearing in <br />the near future. The County proposes to work with the local <br />legislative delegation in establishing a date for the bill to <br />become effective. <br />Indian River County requests your cooperation in coordinating this <br />effort with the State of Florida Legislature. <br />Very truly yours, <br />Gary M.
