Short title; statutory authority; applicability. <br />(1) This chapter shall be known and maybe cited as the Indian River County Solid Waste Facilities Impact <br />Fee Ordinance. <br />(2) This chapter shall apply to the entire county, including the municipalities within the county, to the extent <br />permitted by Article VIII, sec 1(f), Florida Constitution. <br />(Ord. No 2005-015, 5-17-05) <br />Section 1007.02. Findings. <br />In addition to those findings and determinations found in Chapter 1000, the board of county <br />commissioners makes the following findings and determinations: <br />(1) The existing solid waste facilities are not sufficient to accommodate anticipated new development <br />without decreasing the existing levels of service. <br />(2) For impact fee calculation purposes, tThe solid waste facilities level of service standard for the <br />county is 2.2 tGR6 OF 3.67 GubiG yaFd6 peF Gapita for permaReRt plus weighted peak seasonal <br />X64 per weighted resident for additional capital assets. <br />(3) General) a€xisting revenue sources are not sufficient to fund capital improvements necessary <br />to accommodate new development however, consistent with the findings of the Indian River <br />County Impact Fee Update Study Final Report Dated September 26 2014 the board has <br />determined to not use impact fees as a revenue source for solid waste facilities- <br />(Ord- No. 2005-015, 5-17-05) <br />Updates are shown with stNke tnFGughs and underlines Strike -through wording will be deleted from <br />the ordinance underlined wording will be added.— <br />Indian <br />dded—Indian River County, Florida, Code of Ordinances Page 23 <br />
