F, MAR 16 1983 <br />* 53 Awa <br />ON MOTION by Commissioner Scurlock, SECONDED <br />by Commissioner Wodtke, the Board unanimously <br />authorized the County's participation as <br />amicus curiae in the above court case. <br />SETTLEMENT - WILMOTH & DEICKLER VS. INDIAN RIVER COUNTY <br />Attorney Brandenburg explained that the Complaint filed <br />by Wilmoth & Deickler arises out of a subdivision approval <br />of Shady Oaks, at which time the Qounty required that the <br />subdivider escrow funds for half the cost of two half roads. <br />The developer objected to that request all the way through <br />the procedure, but the subdivision was approved subject to <br />that condition. The developer has proceeded to build and <br />instituted suit in the meantime stating that the County's <br />action was improper.
