ORDINANCE NO. 2010- 018 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING <br />ORDINANCE AND THE ACCOMPANYING ZONING MAP FOR f 2.17 ACRES <br />LOCATED AT THE NORTHWEST QUADRANT OF S.R. 60 AND 74" AVENUE, FROM <br />PRO, PROFESSIONAL OFFICE DISTRICT, TO CN, NEIGHBHORHOOD <br />COMMERCIAL DISTRICT; AND PROVIDING CODIFICATION, SEVERABILITY, AND <br />EFFECTIVE DATE. <br />WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency <br />on such matters, held a public hearing and subsequently made a recommendation regarding this <br />rezoning request; and <br />WHEREAS, the Board of County Commissioners of Indian River County, Florida, did <br />publish and send its Notice of Intent to rezone the hereinafter described property; and <br />WHEREAS, the Board of County Commissioners held a public hearing pursuant to this <br />rezoning request, at which parties in interest and citizens were heard; and <br />WHEREAS, the Board of County Commissioners determined that this rezoning is in <br />conformance with the Comprehensive Plan of Indian River County. <br />NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of <br />Indian River County, Florida, that the zoning of the following described property situated in <br />Indian River County, Florida, to -wit: <br />A portion of Tract 8, in Section 1, Township 33 South, Range 38 East, Indian River Farms <br />Company subdivision, as recorded in Plat Book 2, Page 25, of the public records of St. Lucie <br />County, Florida, said land now lying and being in Indian River County, Florida, and being more <br />particularly described as follows: <br />Commence at the Southeast corner of the Northeast 1/4 of said section 1; thence N 00'27'18"E. <br />along the East line of said section 1 a distance of 162.73 feet; thence N 89°40'39"W. Along the <br />North right-of-way line of State Road 60 (232 foot wide right of way) a distance of 80.00 feet to <br />an intersection with the West right-of-way line of 74th Avenue (80.00 foot wide right-of-way) <br />and the point of beginning of the herein described parcel; thence continue N 89°40'39"W. <br />Along the said North right-of-way line of State Road 60 a distance of 361.50 feet; thence N <br />00'27'17"E, a distance of 261.49 feet; thence S 89°40'40"E. A distance of 361.50 feet to the <br />said West right-of-way line of 74th Avenue; thence S00°27' 18"W along said West right-of-way <br />line a distance of 261.49 feet to the point of beginning.
