MAY 41983 a®ac <br />ON MOTION BY Commissioner Scurlock, SECONDED <br />by Commissioner Lyons, the Board unanimously <br />accepted the figure of $12,468.00 as being the <br />balance due the County by the Town of Indian <br />River Shores under agreement dated January 25, <br />1982. <br />UPDATE ON VISTA ROYALE LAWSUIT <br />X953 PAGE 466 <br />Attorney Brandenburg noted that the Vista Royale Condominium <br />Association has sued the County re imposition of the new County <br />water rates, and he has given the County a copy of the Complaint <br />which is 21 pages long. He stated that he wanted to bring this <br />up to give the Board an opportunity to supply his office any <br />input with respect to the suit. He has filed a Motion to Dismiss <br />the complaint for various grounds, and this will be heard some <br />time in June. After that the County will be required to answer <br />the Complaint, state its position, and bring forth any defenses <br />and counterclaims. The Attorney stated that it was his <br />understanding that the County's position always was that they <br />intended to adopt and still intend to have a fair rate fee <br />ordinance for the entire County system, and some time ago the <br />County hired a consultant to do'a study and make recommendations <br />as to whether the present fee structure is an equitable one, <br />which study will be received shortly. If their recommendations <br />indicate the ordinance is fair and proper, his -office will be in <br />a position to move ahead and defend it. If they suggest certain <br />modifications, the Attorney believed the Board should make those <br />modifications adopting a fair ordinance, and this will put Vista <br />Royale in a, position of either accepting the ordinance or <br />amending their lawsuit to attack the new ordinance. <br />Administrator Wright stated that they hope to finalize the <br />study Monday and then he will come back to the Board. <br />Chairman Bird asked if a workshop is needed, and Commis - <br />109 <br />
