WHEREAS, the petition has been verified and <br />r meets the requirements of Ordinance 81-27, and <br />i design work including cost estimates has been <br />Icompleted by the Public Works Department; and <br />WHEREAS, the total estimated cost of the pro- <br />posed improvements is $19,279.64; and - <br />WHEREAS, the special assessment provided <br />hereunder shall, for any given record owner of <br />property within the area specially benefited, be In <br />an amount equal to that proportion of seventy -,five <br />percent (75%) of the total test of the project <br />which the number of lineal feet of road frontage <br />owned by the given owner bears to the total num- <br />ber of lineal feet of road frontage within the area <br />specially benefited, and shall become due and <br />payable at the Office of the Tax Collector of In- <br />dian River County ninety (90) days atter the final: <br />determination of the special assessment pursuant.] <br />to Ordinance 81-27- and <br />WHEREAS, Indian River County shall pay they <br />.remaining twenty-five percent (25%) of the total, <br />cost of the project; and <br />WHEREAS, any special not paid <br />within said ninety (90) day period sha11 bear inter- <br />est beyond the due date at a rate established by <br />the Board of County Commissioners at the time of <br />preparation of the final assessment rail, and shall <br />ibe payable in two (2) equal Installments, the first <br />to be made twelve (12) mordhs from the due date <br />and the second to be made twenty-four (24) <br />months from the due date; and <br />WHEREAS, after examination of the nature and <br />anticipated usage of the proposed improvements, <br />the Board of County Commissioners has deter- <br />mined that the following described properties <br />shall receive a direct and special benefit from <br />these improvements, to wit: <br />Lots 1 through 11, Block A; Lots 1 and 3 <br />through 12, Block 8; Lots 1 and 3 through 12, <br />Block C; Lots 1 through 11 Block D; as shown on <br />the Plat of Clemann Estates Unit 1 Subdivision on <br />record in Plat Book 3 Page 63 of the Public_ <br />Records of Indian River County, Florida. <br />NOW, THEREFORE, BE IT RESOLVED BY THE <br />BOARD OF COUNTY COMMISSIONERS OF IN- <br />DIAN RIVER COUNTY, FLORIDA, as follows: <br />1. The foregoing recitals are affirmed and rati- <br />fied in their entirety. and dâ–ºahhaga <br />2. A project providing for paving <br />Improvements to 38th Avenue, between 4th Street <br />and 6th Street, heretofore designated as Public <br />Works Project No. 8307, is hereby approved sub- <br />ject to the terms outlined above and an applicable <br />requirements of Ordinance 81-27. <br />The foregoing resolution was offered by Com- <br />missioner and, upon being put to a <br />vote, the vote was as follows: <br />Chairman Richard N.
