Public Works Director Davis reported that 680 of the <br />property owners responded favorably to the petition paving <br />project at a cost of $19,279.64. <br />Chairman Bird opened the Public Hearing and asked if <br />anyone present wished to be heard. There were none. <br />ON MOTION by Commissioner Scurlock, <br />SECONDED by Commissioner Lyons, the Board <br />unanimously closed the Public Hearing. <br />ON MOTION by Commissioner Scurlock, <br />SECONDED by Commissioner Lyons, the Board <br />unanimously adopted Resolution 83-34 <br />providing for certain paving and drainage <br />improvements to 38th Avenue, between 4th & <br />6th Streets. <br />RESOLUTION NO. 83- 34 <br />A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS <br />OF INDIAN RIVER COUNTY, FLORIDA, PROVIDING FOR <br />CERTAIN PAVING AND DRAINAGE IMPROVEMENTS TO <br />38TH AVENUE, BETWEEN 4TH _AND 6TH STREETS; <br />PROVIDING THE TOTAL ESTIMATED COST, METHOD OF <br />PAYMENT OF ASSESSMENTS, NUMBER OF ANNUAL <br />INSTALLMENTS, AND LEGAL DESCRIPTION OF THE AREA <br />SPECIALLY BENEFITED. <br />WHEREAS, the County Public Works Department has received <br />a public improvement petition, signed by more than 2/3 of the <br />owners of property in the area to be specially benefited, request- <br />ing paving and drainage improvements to.38th Avenue, between 4th <br />Street and 6th Street; and <br />WHEREAS, the petition has been verified and meets the <br />requirements of Ordinance 81-27, and design work including cost <br />estimates has been completed by the Public Works Department; and <br />WHEREAS, the total estimated cost of the proposed <br />improvements is $19,279.64; and - <br />WHEREAS, the special assessment provided hereunder <br />shall, for any given record owner of property within the area <br />I <br />45 <br />8�1( <br />MAY 4 193 , 53 rAcE ��'j <br />
