comprehensive plan amendment process. Not only will the <br />procedures serve as a review guide for the staff; they will also <br />provide potential applicants for plan amendments with -a specific <br />delineation of the review process. <br />Included as part of the draft amendment procedures is a proposed <br />fee schedule for comprehensive plan amendment requests. Since <br />one of the three types of amendments involves a mandatory review <br />and update of the Plan by the County, no fee was set for that <br />type of amendment. For both types of amendments involving the <br />future land use element of the Plan, however, fees have been <br />proposed. The basis for developing these fees was the existing <br />County fee structure as well as time and cost estimates for <br />reviewing and processing amendment requests. <br />At their meeting of April 14, 1983, the Planning and Zoning <br />Commission considered the draft Comprehensive Plan Amendment <br />Procedures and the proposed fee schedule. Based upon their <br />review, the Planning and Zoning Commission recommended that the <br />Board of County Commissioners adopt the Comprehensive Plan <br />Amendment Procedures and the fee schedule as proposed. <br />ALTERNATIVES & ANALYSIS <br />The comprehensive plan amendment review procedures, as proposed, <br />reflect the requirements of Chapter 163.3191, Florida Statutes. <br />By mandating reviews, public notice, public hearings, and other <br />actions, state law reduces the County's alternatives for <br />developing amendment procedures., There are, however, <br />alternatives for developing a fee structure for amendment <br />requests. <br />Since the Local Government Comprehensive Planning Act does not <br />address plan amendment fees, the County is not required to adopt <br />fees. To recover a portion of the County's costs for reviewing <br />proposed plan amendments, however, the staff has developed a fee <br />schedule based uponestimates of staff time and costs associated <br />with amendment request reviews and also based upon existing fees <br />charged by the County for comparable review activities. Varying <br />by the amount of land area involved in the amendment request, the <br />proposed fees only reflect a part of the County's cost, but they <br />differentiate between amendments for large and small sites and <br />should reduce frivolous amendment requests. While the staff <br />supports the fee structure proposed, otheF alternatives range <br />from no fees to fees which would reflect a higher percentage of <br />the County's cost to review and process proposed amendments. <br />It is the staff's opinion that the draft amendment procedures <br />meet the applicable state requirements, correspond to <br />Comprehensive Plan mandates, and establish an adequate guide for <br />staff review of amendment requests. <br />RECOMMENDATION <br />The staff recommends that the draft Comprehensive Plan Amendment <br />Procedures and the proposed fee schedule be adopted by the Board <br />of County Commissioners. <br />Mr. Keating went into considerable detail explaining how <br />staff arrived at these procedures and suggested fees and the <br />factors considered in arriving at them. He noted that the <br />Planning & Zoning Commission has reviewed the amendment proced- <br />ures proposal and fee schedule and recommended adoption of both. <br />97 <br />MAY 41983 � d <br />
