W <br />Attorney Brandenburg commented that the January date was set <br />by Ordinance, but it could be changed. <br />Considerable discussion followed regarding the time frame <br />involved, and as to whether the Commission can initiate an <br />amendment to the Plan rather than a land owner, and if so, <br />whether it would have to be in January. <br />Mr. King noted that the Plan states that only the Land Use <br />Element will be amended on an annual basis and the other <br />elements, according to State Statute, every five years, but he <br />believed if the Commission should choose to amend the Land Use <br />Element or any other element, they would have the authority to <br />initiate that action at any time of the year. He continued that <br />amendments which involve more than 5% of the County land are <br />generally County initiated, but felt the Commission could <br />initiate amendments concerning smaller areas. <br />Attorney Brandenburg confirmed that the Board could initiate <br />such action. <br />Question arose as to whether the two week period allotted <br />for receiving Comprehensive Plan amendment requests yearly is not <br />overly restrictive. <br />Attorney Brandenburg informed the Board of the rationale <br />behind the time frame, pointing out that if everyone who came in <br />with a zoning that is inconsistent with the Plan were allowed to <br />ask for an amendment at any time during the year, we would be <br />defeating our purpose. <br />Mr. King felt staff will be able to determine better whether <br />two weeks is a sufficient period after they go through this <br />process once. He emphasized that each of these requested <br />amendments will require a lot of staff analysis. <br />Commissioner Scurlock agreed that the Comprehensive Plan is <br />a document which we don't want to change too frequently in any <br />event. <br />Question next arose as to the amount of land that exceeds 50 <br />of the County, and Staff Planner Zimmerman believed that 28.94 <br />99 <br />4 <br />53 PAL 435 <br />MAY 193 <br />
