Request for Quit -Claim Deed from County by Oak Villas <br />The Board reviewed the followinq memo dated 6/28/83: <br />TO: Members of the Board DATE: June 28, 1983 FILE: <br />of County Commissioners <br />SUBJECT: Request for Quit -Claim <br />Deed from County by <br />Oak Villas, General <br />Partnership <br />FROM: Christopher,.'J. Paull REFERENCES: <br />Assistant County Attorney <br />Samuel Block, attorney for Oak Villas, a general partnership devel- <br />oping the Oak Villas project on 6th Avenue at 10th Lane, has <br />requested that the County abandon certain rights-of-way which were <br />thought to be vested in the County along the western and southern <br />boundaries of the developer's property, as shown on the attached <br />Property Appraiser's maps. A closer examination of the title to <br />this property indicates that the right-of-way was never in fact <br />dedicated to Indian River County or the public and that the County <br />has no present vested interest which it can abandon. In order to <br />remove any possible cloud from his client's title, however, Mr. <br />Block has now requested the County to execute a Quit -Claim Deed <br />over that portion of his client's property previously thought to be <br />County right-of-way. The cloud exists as a result of an old <br />"reservation" for public roads in a prior deed which appears to <br />have been carried no further in the chain of title. <br />The parcel in question has never been opened as a road nor main- <br />tained by the County and it has been indicated by the Community <br />Development and Public Works Departments that the County has no <br />present or future desire to establish this as a thoroughfare in any <br />event. <br />As consideration for the County's execution of a Quit -Claim Deed, <br />the developer has offered to grant the County a 15 -foot utility and <br />drainage easement along the western boundary of this property. <br />RECOMMENDED ACTION <br />It is requested that the County <br />and Clerk to execute and deliver <br />order to clear title for the own <br />ize acceptance of a 15 foot util <br />Villas, a general partnership. <br />Commission authorize the Chairman <br />the attached Quit -Claim Deed in <br />er of this property and to author- <br />ity easement in exchange from Oak <br />ON MOTION by Commissioner Scurlock, <br />SECONDED by Commissioner Lyons, the <br />Board unanimously authorized the Chairman <br />and Clerk to execute the twit -Claim Deed <br />requested by Oak Villas, and accepted the <br />15 -ft. utility easement. <br />D <br />
