This letter (see Attachment 1) requested that the County <br />consider amending the land use designations which it had assigned <br />to those County enclaves which are totally surrounded by the Town <br />of Indian River Shores. The letter states the reasons for this <br />request. These reasons include establishing lower allowable <br />building densities, which would conform to the allowable building <br />densities which Indian River Shores has assigned within its <br />jurisdiction, as well as protection of the County's natural <br />resources, maintenance of traffic and utility capacities and <br />flood control. <br />Because the enclaves listed in the amendment request are private- <br />ly owned and within the County's jurisdiction, the Town of Indian <br />River Shores cannot submit a formal plan amendment application. <br />According to F.S. 163.3163 (Local Government Comprehensive <br />Planning Act) the County, as governing body for the landowners of <br />the subject properties, can change the land use designation of <br />these subject properties in the absence of land use amendment <br />requests from the individual property owners. <br />This would involve the redesignation of 21 parcels of land (see <br />Attachment 3). The request from Indian River Shores was that the <br />Land Use Plan designation of all unincorporated land from a point <br />starting 400' west of S.R. A -1-A and continuing westward to the <br />Indian River be amended to conform to the City's R-lA zoning <br />classification. This classification has a maximum allowable <br />building density of 2.9 dwelling units/acre. Therefore, the land <br />use plan would have to be amended from LD -2 to LD -1 for those <br />parcels numbered 3-23 on the map in Attachment 3. The Town also <br />requested that all parcels east of this line be designated in <br />conformance with the Town's R -2A zoning classification. Since. <br />these parcels (1 & 2) are currently designated LD -2 (6 dwelling <br />units/acre), and the Town's current zoning classification allows <br />construction of 6 dwelling units/acre, no land use amendment <br />would be needed for these parcels. <br />ALTERNATIVES AND ANALYSIS <br />There are several points which should be considered in evaluating <br />this amendment request. <br />First, when the Comprehensive Plan was being formulated, the <br />Board of'County Commissioners considered the land use designation <br />of all County enclaves which were surrounded by the Town of <br />Indian River Shores. At that time, the Board determined that the <br />land use designation of these parcels should be LD -2. The Board <br />will have to decide, at this time, if there is a need to review <br />this decision. <br />A second point which needs consideration is that, if the County <br />does initiate a land use amendment application, this will allow <br />the County to compare the County's land uses in the area with the <br />adjacent land uses in Indian River Shores. As part of the <br />application review process, staff would be able to analyze <br />whether the LD -2 land use designation is consistent or inconsis- <br />tent with the actual land uses in both the County enclaves and <br />the Town of Indian River Shores. <br />Thirdly, in reviewing recent land development applications, the <br />Board of County Commis,sioners has commented that the Town of <br />Indian River Shores' land use regulations should be considered <br />when development applications for County enclaves are submitted. <br />Consideringa change in the land use designation of these <br />enclaves would conform with this policy of cooperation between <br />Indian River Shores and the County. <br />RECOMMENDATION <br />Staff recommends that the Board of County Commissioners consider <br />all the facts in the Town of Indian River Shores' request and <br />make a decision as to whether the County should initiate its land <br />use amendment procedure. <br />® W M <br />
