I <br />J U L <br />6 <br />1983 <br />Stix <br />' <br />f A .92 <br />the <br />County and resolve matters without going to <br />trial. <br />He <br />felt that the County is close to being in a position to <br />judge whether or not to go to trial. He explained that the <br />attorneys have scheduled a meeting for this afternoon at two <br />o'clock. He felt that to enter into negotiations of any <br />meaning, a County Commissioner should sit in on this and any <br />additional meetings. If that wasn't possible, then perhaps <br />the Board could authorize the Legal Dept. to do whatever was <br />necessary. Attorney Brandenburg stressed that it is <br />important that a decision be made on whether we are capable <br />of reaching a settlement on the matter or whether we are <br />going to spend the necessary funds to take the matter to <br />trial. <br />During discussion, it was pointed out that the con- <br />struction company's claim is $800,000 and the architect's <br />claim amounts to $150,000. Mr. Reinhold had indicated that <br />he has expended over $50,000 in attorney fees on this case <br />alone. The County has paid outside counsel in the <br />neighborhood of $22,000-24,000, plus the fees of the <br />arbitration firm of Collins -Brown who hired Jones -Foster out <br />of Palm Beach county to handle the appeal. To date, the <br />County is approaching $35,000-$38,000.in attorney fees. <br />Attorney Brandenburg estimated that a trial would last about <br />two weeks and involve considerable expense. <br />In discussion, Attorney Brandenburg stated that there <br />was some thought that the Commission representative should <br />be one of the two Commissioners who were in office at the <br />time the original agreements were approved, either <br />Commissioner Lyons or Commissioner Wodtke.
