JUL 61983 <br />l' <br />LEASE AGREEMENT <br />THIS LEASE AGREEMENT made this6th day of July, 1983, <br />by and between Indian River County, a political subdivision of the <br />State of Florida, hereinafter referred to as "County" and the City <br />of Fellsmere, a municipal corporation existing under the laws of <br />the State of Florida, hereinafter referred to as the "City". <br />RECITALS <br />WHEREAS, Indian River County on November 2, 1944, <br />adopted a resolution dedicating for public use and purpose certain <br />lands described in Exhibit "A" attached hereto, and <br />WHEREAS, said resolution was never recorded in the <br />Official Record Books of Indian River County and there was never a <br />formal conveyance of the property by a recorded legal instrument, <br />and <br />WHEREAS, the City, however, took possession of the <br />property and has held the property for municipal purposes for many <br />years, and <br />WHEREAS, both parties are now in doubt as to the legal <br />affect of the 1944 resolution and wish to settle forever the <br />status of the property in a manner that is consistent with both <br />governmental agencies' goals and objectives. <br />NOW, THEREFORE, in consideration of the mutual promises <br />and undertakings hereinafter contained both parties agree as <br />follows; <br />1. The parties agree that Indian River County owns fee <br />simple title of the property described in Exhibit "A" attached <br />hereto and that by the execution of this agreement the parties <br />hereto acknowledge and agree that the resolution dated November 2, <br />1944, copy of which is attached hereto, is null and void and has <br />no legal affect whatsoever. <br />2. Indian River County ratifies and confirms the <br />City's right to use the property from November 2, 1944, to date <br />and the City acknowledges full responsibility for all liability <br />associated with the use of the property by the City or those using <br />the property with the City's permission to date. <br />3. For consideration of the sum of ONE DOLLAR ($1.00) <br />
