Chairman Bird opened the Public Hearing and asked if <br />anyone wished to be heard. <br />Attorney Rene VanDeVoorde, representing Pelican Pointe <br />Utilities, stated he was here today to answer any questions. <br />Mr. Lawrence Futch, 95th St. at U.S. #1, expressed <br />concern about the effect it would have on his water supply <br />as he now has a shallow well with good water. <br />Director Pinto stated that the water is coming from a <br />deep,well, the Florida aquifer, and will be treated.by a <br />reverse osmosis plant. He did not feel that it would have <br />an effect on Mr. Futch'`s shallow well. <br />ON MOTION by Commissioner Scurlock, <br />SECONDED by Commissioner Wodtke, the <br />Board unanimously closed the Public <br />Hearing. <br />Attorney Brandenburg pointed out that the franchise fee <br />sets the fee at 3% and does not make any mention of being <br />able to amend it by ordinance or otherwise. <br />Administrator Wright recommended that since this <br />question just arose, we adopt this with the understanding <br />that proper language be included to allow the franchise fee <br />to be increased by subsequent action of the Board. <br />ON MOTION by Commissioner Scurlock, <br />SECONDED by Commissioner Lyons, the Board <br />unanimously adopted Resolution 83-66 <br />for approval of franchise application by <br />Pelican Pointe, with the understanding that <br />proper language be included to allow the <br />franchise fee to be increased by subsequent <br />action of the Board. <br />66 <br />SEPI <br />1983 PACE` <br />ry <br />
