Also present is one of the engineers <br />hired by Mr. Wilson, who will testify that Mr. Wilson <br />purchased a wastewater plant from the Le Mer development in <br />Indian River Shores that will be transported to the site <br />this week. Attorney O'Neill further noted that Building <br />Director Rymer testified as to the inspections made. <br />Commissioner Scurlock asked if the plant that is being <br />purchased has been approved by our utility department as <br />required. <br />Steven Mueller, engineer from Sippel & Masteller <br />Assoc., Sebastian, reported that he did approach the County <br />Utility Department informally regarding purchase of the <br />plant. Mr. Pinto is aware of this; it is a new plant and a <br />proven process. They do not, however, have formal approval <br />from the Utility Department. <br />Attorney O'Neill informed the Board that he is not <br />familiar with the deed of transfer which apparently was made <br />to Maple Leaf Properties, but he believed this is a fully <br />owned company. <br />Considerable discussion ensued regarding the transfer, <br />and Attorney Brandenburg believed that.any transfer, even <br />one to an owner, represents a transfer of ownership; <br />however, the position the Board adopted last week was that <br />such a transfer would not automatically void the site plan, <br />but that it would be voided unless the transfer was approved <br />by the County. <br />Attorney O'Neill stated that Mr. Wilson changed title <br />only from his individual name to his own corporate name for <br />liability reasons; there was no attempt to circumvent the <br />law. Since July 28, 1982, staff has been fit to continue <br />telling Mr. Wilson he had the right to continue, on which <br />basis he has expended more money, and Attorney O'Neill, <br />therefore, respectfully requested that the Board consider <br />1.11 <br />SEP 211983 bo x 54 PAcE 719 <br />
